Terms & Conditions

A wedding date is not considered reserved until the required contract has been signed and a 35% retainer has been received.

The retainer is non-refundable and compensates Underground Studio for reserving the date and declining other potential bookings.

No date will be held based solely on an inquiry, verbal agreement, email conversation, or proposal.

The remaining balance is due 14 days before the wedding date.

If the balance has not been paid by the due date, Underground Studio reserves the right to suspend or cancel services until payment has been received.

Unless otherwise specified in writing, all prices are based on the services, coverage time, team size and deliverables described in the client's contract or invoice.

If the client cancels the wedding, the 35% retainer remains non-refundable.

Any additional amounts paid will be handled according to the cancellation provisions contained in the client's signed contract.

A cancellation must be communicated to Underground Studio in writing.

If a wedding needs to be postponed, Underground Studio will make reasonable efforts to accommodate the new date, subject to availability.

Unless otherwise agreed in writing, a rescheduled wedding must take place within 12 months of the original wedding date.

If Underground Studio is unavailable for the requested new date, the original retainer remains non-refundable.

Significant changes to the date, location, coverage requirements, or scope of the event may require a revised proposal or contract.

Coverage begins and ends at the times specified in the contract.

If the wedding schedule runs late, this does not automatically extend the contracted coverage time.

Additional coverage may be requested and will be subject to team availability and the applicable overtime rate.

The client is responsible for providing an accurate wedding timeline and communicating significant schedule changes before the event whenever possible.

Underground Studio may work alongside other wedding vendors and content creators.

Other photographers, filmmakers, content creators, guests or vendors must not substantially interfere with our ability to photograph or film the wedding.

We cannot guarantee specific photographs, footage, angles or moments when our team's access or visibility is obstructed by guests, vendors, venue restrictions or circumstances outside our control.

The client acknowledges that they are hiring Underground Studio based on our existing portfolio and creative style.

This includes our approach to composition, lighting, posing and direction, documentary coverage, color treatment, editing, image selection and filmmaking.

While we welcome inspiration and information about important people or moments, we do not guarantee the recreation of specific photographs, poses, Pinterest images, editing styles or work produced by another photographer or filmmaker.

Underground Studio will make reasonable efforts to photograph requested people, groups, details and important moments.

Clients should provide important family group combinations before the wedding when requested.

We cannot guarantee every requested photograph or moment due to timing, cooperation of participants, weather, lighting, venue restrictions, guest interference or circumstances outside our control.

Underground Studio determines which photographs are suitable for final delivery.

Duplicate images, test shots, missed-focus photographs, unflattering expressions, accidental frames and other images that do not meet our professional standards may be removed during the selection process.

The number of final photographs may vary depending on the wedding, coverage duration, schedule, number of photographers and events taking place.

All delivered photographs receive our standard professional color correction and editing.

RAW photographs and unedited video footage are not included unless specifically stated in the client's collection or separately agreed to in writing.

The standard photography deliverable consists of professionally selected and edited high-resolution JPEG files.

RAW files remain the property of Underground Studio and are not considered part of the standard final deliverables.

When included in a collection, selected photographs may receive additional detailed portrait retouching beyond our standard editing.

This may include subtle skin refinement and other detailed adjustments at Underground Studio's discretion.

Additional retouching outside the amount included in the client's collection may be purchased separately.

Wedding photography sneak peeks are delivered within 48 hours after the wedding, when included in the client's collection.

Sneak peeks represent a small preliminary selection and are separate from the complete final wedding gallery.

The complete edited wedding photography gallery will be delivered within a maximum of 14 days after the wedding, unless a different delivery period is specifically stated in the client's signed contract.

Exceptional circumstances outside Underground Studio's reasonable control, including serious technical issues or force majeure events, may affect delivery times.

When a wedding video teaser is included in the client's collection or offered as a courtesy, it will be delivered within 14 days after the wedding.

The teaser is a separate early-delivery film and does not replace or alter the delivery period for the client's final wedding films.

Final wedding films, including Wedding Films and Highlight Films, are delivered within a maximum of 60 days after the wedding.

A different delivery period may apply when specifically stated in the client's signed contract.

Exceptional circumstances outside Underground Studio's reasonable control may affect delivery times.

When drone footage is included or offered as a courtesy, it is always subject to weather conditions, local regulations, venue rules, airspace restrictions, safety considerations and the drone operator's professional judgment.

Drone operation can never be guaranteed.

If drone coverage cannot safely or legally be performed, its absence does not constitute a failure to provide the contracted photography or filmmaking services and does not create a right to a refund unless the contract explicitly states otherwise.

For filmmaking collections that include ceremony or speech audio, Underground Studio will make reasonable professional efforts to capture usable audio.

Audio quality may nevertheless be affected by venue sound systems, interference, wind, guest noise, officiant restrictions, equipment placement or other circumstances outside our control.

Lasers used by DJs, venues, entertainment providers or lighting companies can permanently damage professional camera sensors.

The client agrees to request that lasers not be used during Underground Studio's photography or filmmaking coverage.

Underground Studio reserves the right to stop photographing or filming immediately if lasers or other equipment present a reasonable risk of damaging our cameras or equipment.

When required by the client's contract, appropriate vendor meals must be provided for Underground Studio team members.

Meals should preferably be served at the same time as the couple or guests so that coverage can resume before scheduled speeches, dances or other events.

Any photography, filmmaking, access, permit, transportation, parking, resort, venue or outside-vendor fees charged by a venue or third party are the client's responsibility unless specifically included in writing.

All photographs, films, video footage and other creative work produced by Underground Studio remain protected by copyright.

Purchasing photography or filmmaking services does not transfer copyright ownership to the client.

Clients may download, print, share and publish their delivered photographs and films for personal, non-commercial purposes.

Images and films may not be sold, commercially licensed, substantially altered or used by third parties for commercial advertising without permission from Underground Studio.

Clients are welcome to share delivered photographs and films on social media.

We appreciate credit to Underground Studio when our work is published online.

Filters or substantial alterations that misrepresent the original work are discouraged.

Unless otherwise agreed in writing, the client grants Underground Studio permission to use photographs and films created during the wedding for our portfolio, website, social media, publications, competitions, advertising, studio samples and other promotional purposes.

Clients requiring complete privacy should discuss this with Underground Studio before booking so that applicable restrictions can be included in the contract.

Photography and filmmaking are subjective creative services.

Differences in personal preference regarding composition, expressions, poses, editing, color, music, pacing or other artistic decisions do not constitute a failure to provide the contracted service when the delivered work is reasonably consistent with Underground Studio's portfolio and agreed scope.

Underground Studio uses professional equipment and reasonable backup procedures.

In the unlikely event that photographs or footage are lost, damaged, corrupted or destroyed due to circumstances beyond our reasonable control, Underground Studio's liability will be limited as provided by the signed contract and applicable law.

Underground Studio will not be considered in breach of its obligations when performance becomes impossible or materially affected by circumstances outside our reasonable control.

This may include severe weather, natural disasters, government restrictions, civil unrest, transportation disruption, serious illness or injury, venue closure, emergencies or other force majeure events.

When possible, both parties will make reasonable efforts to find an appropriate solution, including rescheduling where applicable.

To the extent permitted by applicable law, Underground Studio's total financial liability relating to the commissioned services will not exceed the amount actually paid by the client for the affected services.

Nothing in these Terms & Conditions is intended to exclude rights or liabilities that cannot legally be excluded.

By signing an Underground Studio contract and/or paying the required wedding retainer, the client confirms that they have reviewed and accepted the terms applicable to their booking.

Where a signed contract contains terms that differ from this website, the signed contract takes precedence.

A 50% non-refundable retainer is required to reserve the session date and time.

The remaining 50% balance is due in cash on the day of the photo session, before the session begins.

A session is not considered reserved until the required retainer has been received.

If the client cancels the session, the initial 50% retainer remains non-refundable.

If the client needs to reschedule, they should contact Underground Studio as soon as possible.

Rescheduling is subject to photographer availability.

Repeated rescheduling or significant last-minute changes may require a new booking payment.

Outdoor sessions are subject to weather conditions.

Puerto Vallarta and other tropical destinations can experience rapidly changing weather, particularly during rainy season.

Underground Studio will determine whether conditions make a session unsafe or impractical.

Clouds, wind, humidity, changing light or a possibility of rain do not automatically require cancellation.

If Underground Studio determines that weather prevents the session from reasonably taking place, we will attempt to reschedule based on availability.

Clients should arrive at the agreed meeting point on time.

Underground Studio provides a 15-minute waiting tolerance from the scheduled starting time.

If the client has not arrived within 15 minutes and has not contacted Underground Studio to advise us of the delay, a $50 USD lateness fee will be required in order to continue with the session.

After 30 minutes of waiting, if the client has not arrived, the session will be considered cancelled. Payments already made are non-refundable.

Late arrival does not extend the originally scheduled end time of the photo session. Arriving late may therefore result in a shorter session.

The client is responsible for informing Underground Studio of any accessibility limitations or special requirements before the session.

Some locations may require entrance fees, permits, transportation costs, resort access or photography fees.

Unless specifically included in the package, these costs are the client's responsibility.

Access to beaches, hotels, resorts, private properties or other locations cannot be guaranteed when controlled by third parties.

Clients are booking Underground Studio based on our portfolio and photographic style.

We provide direction when necessary while aiming to create photographs that feel natural and authentic.

We cannot guarantee exact recreations of photographs found online or images created by other photographers.

Underground Studio selects the photographs included in the final gallery.

RAW files, test photographs, duplicates, missed-focus images, accidental frames and photographs that do not meet our professional standards are not included.

Delivered photographs include Underground Studio's standard professional editing.

Detailed beauty retouching, extensive body modification, object removal, background reconstruction, clothing alterations or other advanced manipulation is not included unless specifically stated in the package.

Additional retouching may be available for an additional fee.

The complete edited photo-session gallery will be delivered through an online gallery within a maximum of 14 days after the photo session.

A different delivery period may apply when specifically stated in the client's contract or booking agreement.

Exceptional circumstances outside Underground Studio's reasonable control may affect delivery times.

All photographs created by Underground Studio remain protected by copyright.

Purchasing a photography session does not transfer copyright ownership to the client.

Clients may download, print, share and publish their delivered photographs for personal, non-commercial purposes.

Images may not be sold, commercially licensed, substantially altered or used by third parties for commercial advertising without permission from Underground Studio.

Clients are welcome to share their delivered photographs on social media.

We appreciate credit to Underground Studio when our work is published online.
